Ticket Buyer Terms & Conditions

These Ticket Buyer Terms (“Ticket Terms”) govern your purchase, use, and attendance of any event ticketed through The Elite Pass (theelitepass.com). By purchasing or using a ticket, you (“Consumer,” “Attendee,” “you”) agree to these Ticket Terms.

1. The Elite Pass Is Not the Event Organizer

• Does not organize or host the event
• Does not set prices, schedules, or policies
• Does not guarantee event quality or safety
• Is not responsible for performer, venue, or organizer actions
• Provides ticketing technology, event listing platform, payment processing, and attendee management tools

2. Your Contract Is With the Event Organizer

• You are entering a contract directly with the Organizer
• The Elite Pass acts only as a platform or payment facilitator
• Refunds, event changes, and conditions are controlled by the Organizer
• Organizer contact information is shown on the event page

3. Accuracy of Buyer Information

• Provide accurate name, email, and contact details
• Do not use fake identities or fraudulent payment details
• Keep purchase confirmation safe
• Verify event details before checkout

4. Purchases, Payments & Pricing

• Purchases are final unless the Organizer’s refund policy allows otherwise
• Taxes, platform fees, and payment processing charges may apply
• Bank/credit card fees are not controlled by The Elite Pass
• Valid and authorized payment methods must be used
• The Elite Pass may cancel orders suspected of fraud or unauthorized use

5. Refunds & Cancellations

• Refund rules depend on the Organizer’s refund policy, not The Elite Pass
• Refunds may be allowed if the event is canceled or required by law
• Refunds are not guaranteed if you change your mind, miss the event, or the event does not meet your expectations

6. Ticket Usage & Validity

• Valid only for the event, date, and time listed
• Must be presented at entry (digital or printed)
• ID verification may be required
• Must not be modified, copied, resold, or transferred improperly
• Tickets may be invalidated if duplicated, refunded, lost, stolen, or obtained from unauthorized resellers

7. Entry Conditions & Event Policies

• Subject to Organizer’s rules: age restrictions, dress code, security, prohibited items, venue policies, seating arrangements, late entry restrictions
• Failure to follow rules may lead to denied entry, removal, or no refund

8. Event Changes

• Events may be rescheduled, postponed, modified, or relocated
• Organizer is responsible for informing attendees
• Refund eligibility depends on Organizer policy
• The Elite Pass is not responsible for travel, accommodation, or personal losses

9. Safety & Conduct

• Behave safely and respectfully
• Prohibited: violence, harassment, excessive intoxication, disturbing performers or attendees, breaking venue rules, illegal activity
• Organizers may remove you without refund

10. Prohibited Uses of Tickets

• No scalping, forging, or duplicating tickets
• No unlawful use or improper transfer
• No promotion of tickets for business without consent
• Unauthorized resale may void the ticket

11. Liability & Assumption of Risk

• Events may involve risk (crowds, weather, physical activity, etc.)
• You voluntarily accept all risks associated with attendance
• The Elite Pass is not responsible for injuries, illness, lost items, third-party actions, venue safety, or event quality
• Liability is limited to the ticketing fees paid to The Elite Pass for the specific event

12. Chargebacks

• Payment disputes may initiate chargebacks
• Organizer may dispute with evidence
• Excessive or fraudulent chargebacks may result in account suspension
• Chargebacks cannot substitute for Organizer’s refund policy

13. Communication & Notifications

• Receive order confirmations, event updates, change/cancellation notices, entry instructions, customer service messages, optional marketing (if opted-in)
• Delivered via email, SMS, or notifications

14. Data Privacy

• Data handled according to Privacy Policy, Cookie Policy, and applicable laws
• Organizers receive only attendee information necessary to operate the event

15. Tickets for Minors

• Adult guardian may be required
• Age ID may be required
• You are responsible for minors’ conduct
• Some events prohibit minors entirely

16. Prohibited Events & Listings

If you encounter an unsafe, fraudulent, illegal, or misleading event, report it to: support@theelitepass.com. We will investigate and may remove the event or contact the Organizer.

17. Modification of Terms

We may update these Ticket Terms to improve safety, comply with law, or reflect platform changes. Updated terms become effective upon publication.

18. Governing Law

All disputes related to ticket purchasing and event attendance follow the jurisdiction and arbitration rules defined in The Elite Pass Terms of Service. Venue for disputes (if not arbitrated): San Francisco County, California, USA.
